[0]Hugh Pickens writes "Polls by Gallup and the Pew Research Center find
that four out of 10 Americans believe humanity descend from Adam and Eve,
but NPR reports that evangelical scientists are now saying publicly that
they can no longer believe the Genesis account and that it is [1]unlikely
that we all descended from a single pair of humans. 'That would be
against all the genomic evidence that we've assembled over the last 20
years so not likely at all,' says biologist Dennis Venema, a senior
fellow at BioLogos Foundation, a Christian group that tries to reconcile
faith and science. 'You would have to postulate that [2]there's been this
absolutely astronomical mutation rate that has produced all these new
variants in an incredibly short period of time. Those types of mutation
rates are just not possible. It would mutate us out of existence.' Venema
is part of a growing cadre of Christian scholars who say they [3]want
their faith to come into the 21st century and say it's time to face
facts: There was no historical Adam and Eve, no serpent, no apple, no
fall that toppled man from a state of innocence."

At 1:51 p.m. EDT a [0]5.8 magnitude earthquake hit Virginia ([1]map of
reported tremors). Reports indicate it was felt [2]along most of the east
coast (my monitor and floor definitely wobbled a bit down here in Raleigh
NC) with reported [3]evacuations of government buildings at least in DC.
[4]QuantumPion noted that the [5]North Anna Nuclear Generating Station is
located only a few miles from the epicenter, and the NRC has [6]confirmed
the plant automatically shut down with no apparent damage. For folks who
like that sort of thing, there is [7]a hashtag on Twitter, and the WSJ

Over 11 years ago, Deus Ex became one of the most celebrated games of its
time, tightly weaving FPS and RPG gameplay together with a rich cyberpunk
story. Today, Eidos Montreal and Square Enix launched a new entry to the
series, titled Deus Ex: Human Revolution. A [0]launch trailer is
available, and early reviews for the game are positive. Opposable Thumbs
says, "Fans can take a deep breath: they will [1]get what they want from
a Deus Ex game in this release. [2]The story is dense, complete with
twists, interesting characters, and far-flung locations." Rock, Paper,
Shotgun largely agrees, and both reviews praise [3]the breadth of choices
players have in how they accomplish mission objectives. However, they
disagree on the quality of the voice acting, and RPS complains of
untimely and oddly-designed boss battles. DE:HR's stealth gameplay and
hacking minigame receive high marks, as does the game's overall length
and replayability.

Oracle says [0]no court has ever found that APIs for software like Java

Oracle's copyright allegations. In early August, Google asked the judge

utkonos writes "After decades of pondering, scientists have found the
secret to the creation of lager. An elusive species of yeast isolated in
the forests of Argentina was key to [0]the invention of the crisp-tasting
German beer. From the article: 'Their best bet is that centuries ago, S.
eubayanus somehow found its way to Europe and hybridized with the
domestic yeast used to brew ale, creating an organism that can ferment at
the lower temperatures used to make lager. Geneticists have known since
the 1980s that the yeast brewers use to make lager, S. pastorianus, was a
hybrid of two yeast species: S. cerevisiae used to make ales, wine and
bread and some other, unidentified organism.'"

[0]CWmike writes "Facebook is making a series of design changes to the
site [1]to make it clearer to users who can see the content that they
post, an issue Google has been criticizing Facebook about since it
launched its own social network, Google+, in June. 'You have told us that
"who can see this?" could be clearer across Facebook, so we have made
changes to [2]make this more visual and straightforward,' Facebook said
in a blog post on Tuesday. The main change is that Facebook will now
display the intended audience for a photo, a text post, a tag or any
other piece of content right next to it. Until now, those controls have
been on a separate Settings section of the profile. 'Your profile should
feel like your home on the web you should never feel like stuff appears
there that you don't want, and you should never wonder who sees what's
there.' Another change Facebook is introducing is allowing users to
modify the audience of a post after it's published, which they couldn't
do before."

Likewise, those of us in the open source community depend heavily on
[0]Oregon State University's Open Source Labs (OSUOSL), but may not even

EFF [1]speculates about the true nature of the Syrian 'hackers' who
[2]defaced AnonPlus. She references a [3]University of Toronto analysis
from May, which pointed out that the supposed independent hacktivist
group the Syrian Electronic Army has a website that is hosted and
registered by the Syrian Computer Society a group that dictator Bashar
Al-Asad used to run and that was founded by his brother. York has
previously written about the mystery of the [4]pro-Asad twitter floods of
April, and the convenient [5]unblocking of social media sites like
YouTube and Facebook earlier in the year, which allegedly allowed the
Mukhabarat to spy on and entrap opposition activists through [6]forged

online. Is the Syrian example evidence against the [8]vision of

Joining the ranks of accepted submitters, [0]Gaygirlie writes "Michael
Robertson, the owner and founder of the [1]MP3Tunes music locker service,
has been [2]locked in a copyright infringement case with EMI Records for
a while now, especially because of the Sideloading search engine that is
tacked along with the locker service. Now the case has been resolved
though: [3]EMI Records won. But lost on all the accounts that actually
really matter." The important parts here are that MP3Tunes was granted
safe harbor protection under the DMCA, and that merging multiple copies
of the same file doesn't make distributing that master copy a public
performance.

Front page first-timer poena.dare writes "The government sought
warrantless access to 113 days of location data for a Verizon Wireless
customer. On Monday, a judge [0]refused the request (PDF), ruling that
[1]cell phone users have an expectation of privacy in location
information. 'There is no meaningful Fourth Amendment distinction between
content and other forms of information, the disclosure of which to the
Government would be equally intrusive and reveal information society
values as private,' said Judge Nicholas Garaufis. Privacy advocates in DC
will be cheering as soon as they climb out from under their desks!"
