26 states and a small business group have filed separate appeals to the
U.S. Supreme Court asking them to [0]strike down Obama's 2010 healthcare
law. In August an appeals court in Atlanta ruled that the individual
insurance requirement was unconstitutional making it almost certain that
the bill would go to the Supreme Court. From the article: "The Obama
administration earlier this week said it decided against asking the full
U.S. Appeals Court for the 11th Circuit to review the August ruling by a
three-judge panel of the court that found the insurance requirement
unconstitutional. That decision cleared the way for the administration to
go to the Supreme Court. The administration has said it believes the law
will be upheld in court while opponents say it represents an
unconstitutional encroachment of federal power."

microphone. The device offers Wi-Fi connectivity, though not 3G access,

$79-a-year membership service that includes streaming video and free

carte pricing, in which users could chose the channels they want, would
undermine the both their own business models and the existence of
important but less-watched channels currently wrapped into bundles.
That's why it was surprising to hear that [1]major cable companies are
privately working towards offering a la carte pricing. But when you look
at the details, it seems [2]more like a bait and switch: those lesser
channels (which pay cable companies for their place on the dial) will
still be bundled with the local stations cable companies are required to
provide, whereas pricey sports channels (which cable companies have to
pay for) will become HBO-like premium services."

In his first accepted submission, [0]lukemartinez sends in an excerpt
from a ZDNet article on continuing developments about Microsoft's [1]UEFI
secure boot requirements: "The Linux Australia community [2]began
petitioning the ACCC this week after Microsoft aired plans to mandate the
enabling of Unified Extensible Firmware Interface's secure boot feature
for devices bearing the 'Designed for Windows 8' logo. This means that
any software or hardware that is to run on the firmware will need to be
signed by Microsoft or the original equipment manufacturer (OEM) to be
able to execute. This would make it impossible to install alternative
operating systems like Linux..." Delimeter has [3]further information on
the petititions, and Matthew Garret recently posted a follow-up to
Microsoft's response to the concerns about secure boot, [4]calling them
out on their misinformation.

New submitter person46 writes "Bethesda's lawsuit against Mojang,
developers of Minecraft, [0]is going to court. As you may recall,
Bethesda is [1]claiming copyright infringement over the title of Mojang's
upcoming CCG/board game Scrolls. Bethesda claims that the name and game
concept are too similar to their well-known RPG franchise The Elder
Scrolls. '[C]ourt documents show that Bethesda lawyers plan to use
comments on Scrolls articles and videos from around the web to show how
people will confuse Scrolls with The Elder Scrolls. He also added that
they've captured screenshots of Scrolls' trailer as a way of showing how
Mojang has copied Bethesda because both Skyrim and Scrolls contain
mountains.' Mojang founder Notch had offered to settle the dispute with
[2]a friendly game of Quake 3, but apparently Bethesda wasn't up for
that."

Council (CSIC) have successfully completed Phase I human clinical trials
of a [0]HIV vaccine in which 90% of volunteers developed an immunological
response against the virus. The MVA-B vaccine draws on the natural
capabilities of the human immune system and 'has proven to be as powerful
as any other vaccine currently being studied, or even more,' says Mariano
Esteban, head researcher from CSIC's National Biotech Centre."

We've been following the Anti-Counterfeiting Trade Agreement for over
three years, from its [0]secretive beginnings, to the controversy and
debate that followed, and to the document it [1]eventually evolved into.
Now, Japan has announced that [2]the agreement will finally be signed on
Saturday during [3]a ceremony that follows an anti-piracy symposium on
Friday. "The negotiation has been carried out among Australia, Canada,
the European Union and its Member States, Japan, the Republic of Korea,
Mexico, Morocco, New Zealand, Singapore, Switzerland, and the United
States, and reached a general agreement at the negotiation meeting held
in Japan in October 2010, followed by the completion of technical and
translation work in April 2011. ... The signing ceremony will be attended
by the representatives of all the participants in the ACTA negotiations,
and those that have completed relevant domestic processes will sign the
agreement. The agreement is open for signature until May 1, 2013."

what can at best be called [1]unfavorable reviews, but Square Enix CEO
Yoichi Wada is finally willing to admit that the (still
subscription-free) MMO [2]'greatly damaged' the entire Final Fantasy
brand. Despite this damage, Wada said Square Enix will continue to work
on 'reviving' the game, with an upcoming patch promising to [3]finally
introduce such series staples as chocobos and airships. Even so, there's
still no word on the PS3 release, which was delayed until the game was
'fixed,' nor is there any sign that Square Enix feels the game will be
worth a subscription fee any time soon."

An anonymous reader tips news of a vulnerability discovered in the
Diebold Accuvote voting system, which could be used to [0]alter voting
results without leaving evidence of tampering. Quoting Salon: "[T]he
Argonne team's attack required no modification, reprogramming, or even
knowledge, of the voting machine's proprietary source code. ... The
team's video demonstrates how inserting the inexpensive electronic device
into the voting machine can offer a "bad guy" virtually complete control
over the machine. A cheap remote control unit can enable access to the
voting machine from up to half a mile away. ... The video shows three
different types of attack, each demonstrating how the intrusion developed
by the team allows them to take complete control of the Diebold
touch-screen voting machine. They were able to demonstrate a similar
attack on a DRE system made by Sequoia Voting Systems as well."

the library association, highlighting 'the benefits of free and open
access to information while drawing attention to the harms of
censorship.' Interestingly, seven of the ten most-censored books [1]are
now available on Amazon's Kindle ��� more than twice as many [2]as last

to send a physical disc containing the data. This has been exploited by a
number of users, [2]completely overwhelming Facebook's ability to make
the discs.

announced a patent licensing agreement that gives Samsung legal coverage
for its use of Google's Android OS in its smartphones. Under the deal,
which covers both mobile phones and tablets, Microsoft says it will
receive unspecified royalties for every Android device that Samsung
sells. Microsoft previously struck a [1]similar patent deal with HTC,
under which Microsoft is reportedly receiving $5 for every Android
handset that HTC sells. This latest deal leaves Motorola Mobility, with
which [2]Microsoft is currently in litigation, as the only major Android
smartphone manufacturer in the U.S. without a license to Microsoft's
patent portfolio."

people have been cleared of charges or had charges dropped. 'If an
individual is acquitted or charges are dismissed for a crime related to

standard in order to remain on, or be subsequently nominated to, the
terrorist watch list,' the once-classified memorandum says. The New York
Times is running a story about it as well saying [1]the data is even used
by local police officers to check names during traffic stops."

dismal news for MeeGo. Quoting the article: "Like the [1]Moblin operating
system before it, Linux-based MeeGo will will be merged out of existence.
MeeGo will become [2]Tizen, Intel said today. 'Intel joined Linux
Foundation and LiMo Foundation in support of Tizen, a new Linux-based
open source software platform for multiple device categories,' the
company said in a statement. 'Tizen builds upon the strengths of both
LiMo and MeeGo and [3]Intel will be working with our MeeGo partners to
help them transition to Tizen,' Intel said. The initial release of Tizen
is expected in Q1 2012, enabling the first devices in the market
mid-2012..." PolygamousRanchKid adds "It seems one of those strengths is
not actually making it into a product on the market yet." This on the
heels of [4]Nokia shipping the N9 (which is actually running a weird
Maemo/Meego hybrid).

non-cooperatively tag, track, and locate individuals from a variety of
military UAV platforms. Quoting Wired: "[The] Army just handed out a

ability to track people persistently across wide areas', says Dr. Tim

upload my existing reviews and I would require my reviews to be
downloadable by me in CSV, at any time in the future. Goodreads allows
for import/export of book reviews, and IMDB allows you to export your
ratings, but what about game and music reviews? What website aggregates
consumer reviews of (all) products, while allowing for each individual
user to easily import and export his own reviews?"

myself making (or recognizing) more and more important decisions being
made in developing for the web. Scalability Rules cemented and codified a
lot of things I had suspected or picked up from blogs but failed to give
much more thought to and had difficulty defending as a member of a team.
A simple example is that I knew state is bad if unneeded but I couldn't
